So having a law that bars communists from office is quite simply a protection of the republic and constitution, but that has nothing to do with "freedom of expression" regarding the rights of citizens.

So what about the right to run for public office?

Yes but if you accuse someone of murder without evidence, you can get in quite a lot of trouble yourself.

Plus this would give commies a legitimate grievance. Besides. If everyone votes to be communist, then hey, their choice.
