he hadnt formed his theory of total war yet

Actually Total War wasnt Modern at all, it was merely a return to Pre-Christian Warfare. Since Augustine, battle had been fought according to rules
except when fighting infidels when 2 Christian peoples fought they had to fight for proper reasons and conduct the battle in such a way not to be brutal

The War For Southern Independence was truly in my mind the last war that began under Just War Theory and ended in modern war
I read Lee's memoirs and although it never mentions it in there, im about 99% sure he ascribed to just war theory
