If you arent conscious during the switch, did you really survive? Or are you now a copy?
Id argue the only way to do it would be to move the consiousness over slowly, moving the sight over first, then the hearing, all while the main consciousness still remains anchored to the physical form, then move the person over segnent by segment
Even then though itd be hard to gauge whether it worked
If you could guarantee that the organic instance of the consciousness was transferred over, and not copied, then id still call that android human

Basically since the dead cannot asser their rights any further, and require others to exercise them, the rights do not belong to them but to others to exercise for them.
