There are federal laws against murder and robbery, and these laws have been justified under the Necessary and Proper Clause of the Constitution, as well as the Commerce Clause.
10A doesn't apply. If it's murder, it can't be up to each state. If it's murder, its a federal issue.
If the fetus is a person, killing it is murder.
