there are people who have assaulted people, used racial slurs openly and loudly, and have been literally shitfaced drunk at work who got a verbal warning because it was their first offense
We have a joke here that if you can't perform in / are too lazy for private sector, you go into the government administration. A law on low performing workers would loose hell here.
