Because there is technically evidence. An affidavit is evidence. And while that affidavit is evidence it may well not go to prove the claim

Yes and affidavit is evidence... as it can be presented to a court. But that does not mean that evidence goes to prove the claim. That evidence might not be reliable or even relevant
