@RobertGrulerEsq Despite you having your background in criminal law: A basic question because it seems some people are getting mislead by certain (to not be named) folks claiming that settlements are not litigation losses. While technically true, I feel this is crucially misinforming people to make the claim that they are credible and can't be wrong.

While settlements are not technically losses (in my opinion) there are contributing factors such as desired relief, and potential litigation costs that can help determine if someone settles, that it's more of a loss rather than taking the approach of less cost. This is particularly in regards to large settlements, and cases in where people settle after receiving court opinions contrary to their defensive interests.
