Gun charges have been dropped against the alleged operator of an illegal gambling ring tied to a vacant bar on West Ridge Road. On Tuesday, a Monroe County Grand Jury failed to indict Daniel Elliott who is also known as "Miami Dan."
"He's ecstatic to have this behind him," said his attorney, Vince Merante.
On January 20, 2017, Rochester Police raided a poker and blackjack operation, shooing away 25 people. They confiscated a small amount of marijuana, cocaine and two semi-automatic pistols - each loaded with seven rounds. One of them had the serial number removed.
"Two illegal pistols were found in a cupboard. My client's fingerprints were not on them," said Merante. He said they were able to prove to police they were owned by someone else.
Police broke up the gathering that night. No one was ever charged with gambling. Rochester Police say the investigation remains open. Merante said he does not anticipate further charges against his client.
Elliott has since moved to Florida. "He has moved on with his life," Merante said.
