I don't think there's a right answer really. This is a hypothetical where there will be consequences either way. Either you risk your own life and prison time, or you risk your daughter being potentially permanently injured or killed while you watch. The idea that you might win a lawsuit after the fact is in most people's eyes not worth risking their daughter, let alone even on their mind in that moment. You can't even really know whether or not your complex functions would be highjacked by the more primal brain until it actually happens. This is definitely a good thought experiment. However, we have already heard Travis's position on this and it doesn't seem like he has considered some of what I've mentioned above. If he has, I'd be very intrigued to hear how he makes his way past it to come to the conclusion that he has.
