State law can override federal law in the US, and that's how it should be
Unless we're talking about our bill of rights

2018-06-23 08:58:38 UTC

What if the Texas Government reject Austin’s resolution?

2018-06-23 08:58:55 UTC

They can do that

2018-06-23 08:59:07 UTC

Well they should

2018-06-23 08:59:10 UTC

Isn't that how they'll get rid of that law

2018-06-23 09:04:48 UTC

Yes

2018-06-23 09:05:06 UTC

idk why

2018-06-23 09:05:13 UTC

they will do it

2018-06-23 09:05:18 UTC

2018-06-23 09:05:23 UTC

maybe they're too dumb

2018-06-23 09:05:37 UTC

Is the Gov. of Texas a Cuck?

2018-06-23 09:05:48 UTC

State Law does not trump Federal law. If they conflict Federal wins every time

2018-06-23 09:05:52 UTC

That’s what Democrats always do, they do dumb shit

2018-06-23 09:06:08 UTC

@Thomas Marik California comes as an example

2018-06-23 09:07:33 UTC

California is not exemplt from Federal Law.

2018-06-23 09:07:43 UTC

Much as they would liek to pretend they are

2018-06-23 09:08:24 UTC

Well California is A shit hole and I don’t see Cox winning California

2018-06-23 09:08:44 UTC

10th Amendment
The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

2018-06-23 09:09:07 UTC

Courts like to rule that the 10th amendment above does not say what it says

2018-06-23 09:09:31 UTC

They also like to do that with plenty of other things as well

2018-06-23 09:12:38 UTC

The constitution lays down a system by which Congress can enact laws. The constitutionality of those laws is determined by the Judicial branch, specifically the Supreme court. The constitutionality of thsoe laws is not determined by the individual state.

2018-06-23 09:14:00 UTC

Yes, this is the result of activist judges who like to say that Black is White and Up is Down

2018-06-23 09:14:19 UTC

Do yourself a favor and ignore those faggots

2018-06-23 09:15:33 UTC

That being said, Congress cannot nullify the Constitution

2018-06-23 09:15:56 UTC

Therefore, the 10th still stands

2018-06-23 09:17:33 UTC

They enact laws, as you say, and the Judicial determines if -those laws- are Constitutional.

2018-06-23 09:19:29 UTC

Are you about to tell me federal immigration law is unconstitutional becasue The Federal government does not have the authority under the constitution?

2018-06-23 09:20:14 UTC

(blinks(

2018-06-23 09:20:17 UTC

No?

2018-06-23 09:20:43 UTC

Then provide an example where Federal law and State law is conflicting and the state law trumps the federal law

2018-06-23 09:21:12 UTC

...every time a state law counters federal law?

2018-06-23 09:21:23 UTC

this is not as complicated as you think it is

2018-06-23 09:22:01 UTC

If the feds say one thing - and the feds are not, in the process, enforcing the Constitution - the states can say another, and that's that

2018-06-23 09:23:02 UTC

So if a state made a law that said they did not have to pay Federal Income tax the state law would win?

2018-06-23 09:23:15 UTC

I'm struggleing to find any example of what you are claiming

2018-06-23 09:23:40 UTC

A few years ago, Missouri nullified all federal gun control within its borders

2018-06-23 09:25:12 UTC

Rather than discuss this fruitlessly, just go skim this
http://tenthamendmentcenter.com/2015/05/16/nullification-made-easy/

2018-06-23 09:26:59 UTC

Basically, states can do what they want

2018-06-23 09:27:12 UTC

Unless the Constitution says otherwise

2018-06-23 09:27:58 UTC

Thus if the federal government passes a law, there is nothing that Constitutionally stops any state from nullifying it via state legislation

2018-06-23 09:39:39 UTC

In order for what you say to be true Article 1 of the Constitution would need to be ignored.
