Murder must be premeditated for example.
The question is what is being done about the current lynchings? Are they not being prosecuted for a reason that making specific laws would change?

1st degree murder is premeditated murder
@GingaBomber It distinguishes between killing someone because you lost control of your car (accidental manslaughter) and intentionally chasing them down and killing them.
The latter is considered worse.
2nd degree is stuff like driving through people
If there were no hate crime laws all you'd need to do after killing someone is say "because I hate his race" and they'd have to let you go free, right
Or shooting someone by mistake
