As far as I understand the judge said the following: "The judgment is a carefully guided prohibition, not a ban, says judge"

Not sure how / what the exact difference is between it being banned or it being placed under "carefully guided prohibition" 🤔

Sounds like a very grey area, not sure how a flag can be seen as hate speech, but what do I know

I get their argument in terms of it was the flag that was associated with apartheid etc. in the same type of way the Nazi Party flag was associated with WWII and everything.

I'm just trying to understand the judge's statement / ruling.

I mean it reads as follows:

Section 10 of the Equality Act:

Prohibition of hate speech

(1) Subject to the proviso in section 12, no person may publish, propagate, advocate or communicate words based on one or more of the prohibited grounds, against any person, that could reasonably be construed to demonstrate a clear intention to-

(a) be hurtful;
(b) be harmful or to incite harm;
(c) promote or propagate hatred.

Specifically it says "publish, propagate, advocate or communicate words" and this is a flag and then the judges goes on to say the following:

"Judge Mojapelo says the restriction of hate speech to words only would not achieve the purpose of the Equality Act" - News24

So does that mean the Equality Act is now going to be adapted because it only says that hate speech is expressed through words, and not a flag or image?

It then ends with "The judgment is a carefully guided prohibition, not a ban, says judge" - News24

So again, I'm not sure what the technically difference is between it being banned vs prohibited (when specifically saying it's not banned).

Confusing much if you ask me 🙈

Melanie Verwoerd has fallen off the train big time lately 🙈 sometimes she maybe had a couple of valid points in the past, but goodness me, the last couple of years, completely missing the plot.

She is so over sensitive and completely missing the plot once again.
So she is proposing all jokes, song and any form of art that makes a stab or a joke about historical gender roles / perceptions (and how ridiculous they are/were) whatever you want to call it should be stopped or banned?

The problem is not with the media or the arts, the root of these problems start with the parents of the children. If kids don't have role models and/or parents that discipline and teach them how to behave so that they will be accepted in a social society as being decent.
I'm not convinced the issue lies with the media / arts, but rather with the parents not teaching their kids what is right or wrong or acceptable or unacceptable behaviour.

Maybe it's just me, but just because I see something in the media or arts, that could be categorized as sexist or whatever isn't going to make me go act it out.

It's like the "studies" about how violent video games make kids violent. Sure there might have been a couple of cases where the violence was that was acted out was attributed to a violent video game. I would have numerous questions about those so cases.
What is a far bigger issue I would argue is again, the parents role in this.
Why are parents allowing 12 year old Jimmy to play or watch R-rated video games or movies. What is the point of the age restrictions if parents just ignore them?
I'm pointing a finger at parents for being the problem in most cases.

Wonder how Melanie would react if someone questioned her about the ANC and how they have managed this country over the last 25 years on a podcast like, Tea with Helen, since she's a former ANC MP.
She'd probably have a fit. Would love to see it though as I'm sure she'll dig excuses out of holes I'm sure I wouldn't even dream of.
