Itโs not moving them, but seeing them and weโll say that itโs the remains of an ancestor removed from you by at least one or two generations (a great grandfather).
If its their land I dont think you have a right to see them. Thats why I mentioned moving them. If you are denied access to them by basis of private property you would most likely only have relocation as your legal recourse.
So say GGF was buried on the family land and that land got sold at sometime. The new owner wouldnt have to let you see him. However the remains I dont think get sold with the land (unless stated) so if denied access you should be able to move them somewhere where you would be able to access them.
It would be kind of like if you left say a car at a house you sold. You cant just go see it anytime you want but it is still yours and you must be allowed to at least retrieve it.
Otherwise they could start charging you upkeep and access fees or some dumb shit like that.
But you canโt move them if you canโt access their property to begin with.
What Im saying is that they would either allow you to access them to move them. If they dont allow you you could sue them or setup some meeting to plan for it. But I would immagine you would need to have a joint agreement drawn up and pay for it all.
Unless they own the grave they cant keep you from it. So as long as you have primary blood relation and they dont have a deed to the grave somehow you should be able to get a court order.
But I dont know the specific details, you should speak with an attorney. Property kind most likely

Handling access to the body is something that should have been worked out when the land was sold or when they were buried there.
There was a guy I worked with whose dad died. He wanted to be buried on his property. From what I understand they had to give up the area he was buried in to the state for access as a utility. Plus the government had to be notified that a body was being buried there. As stated, this was a recent event and not something from 70+ years ago.

Feds can still prosecute regardless of state charges, separate sovereigns.
So the state doesn't have to throw anything out, but often it does because the US Attorneys have a VERY HIGH conviction rate, around 99%, and a larger budget
There could also be federal charges that might get more time. State/local officers have absolutely no authority to enforce federal laws and very little training on them. So any of that stuff absolutely must be tried in federal courts.
The judge dropped it because they didn't have a probable cause hearing within ten days, but with such a high profile and serious case I doubt the prosecution simply forgot about it. Either there's a plan or a major fuckup.
They can still have them indicted by a grand jury and then try the case that way.
