@Jes a false accusation is not necessarily a malicious accusation, proving the latter is considerably more effort.

And cops do try to get false accusers to admit to the false accusations which would then not even be part of those 8%.
There are probably ways to prove that, but that seems like a lot of work.

Well, without exam there might be eye witnesses
well it has to be investigated before it gets to a prosecutor
there may be circumstances which make the exam impracticable
it is more complicated than that.
