Rules vary state to state but generally if a driver forces another to perform an emergency maneuver or evasion, they're at fault and if the driver fails to evade or stop they're still at fault

Like I said. By the time they realize they need to use "emergency stop" they have already hit someone. Their brain does not register it fast enough.
