now of course, even though u can use it as a defense against any accusation, u are still risking an arrest, but usually it is merely a misdemeanor or a minor offense . i rather get arrested for a minor offense than rape, but please bear in mind that there are exceptions codified in law that protects ppl from unlawful recording arrest. every state has slightly different exceptions , so sometimes u still will be in the clear
