Court case where a "not ready weapon" was shown in court to get to the ready and deadly position in plenty of time
The whole case depend on how fast the gun could be made "ready"

The cop did not shoot on the draw either. He even had time to draw his taser with the other hand after issuing verbal commands. Both were not ready to kill that day.

Not saying it would have saved these two guys, but it couldnt have ended any worse
But you can not read intend, especially if your life is on the line. The other guy is a deadly threat and should always be treated as such.
If he points a gun at you, that is, lol. But indeed at least he tried to draw. Would he have been shot if he would have stayed seated? Who knows.
