when the most creative and industrious people aren't allowed to profit from the risk of getting noticed, they stop doing so

instead, they do the mimimal nessecary without invoking the wrath of the mob on them

A lot of companies are outright hostile to their consumer base

To be fair, the government in part allows the corporate structure of the gaming industry to be as it currently is. It would have happened whether or not there was a government to use as leverage, but it seems the tool intended to prevent this problem is in fact exacerbating it.
