I believe the issue here isn’t the question of whether or not it’s an “illegal immigrant”, but the degree of which they are an asylum seeker. Using the USA as an example, it is a right underneath US law to humanitarian protection as long as they enter via an official port of entry-which you will find a significant amount of people who are doing so do.
