tell me how a celeb evades deportation for over 10 yrs

2019-02-18 20:35:59 UTC

Can you post the link to that article?

2019-02-18 20:36:34 UTC

I can finally respond to your question of the day, Gwench

2019-02-18 20:36:46 UTC

@gohan Hey 😃

2019-02-18 20:38:43 UTC

It's a very nuanced question, honestly

2019-02-18 20:40:46 UTC

Hmmm

2019-02-18 20:40:49 UTC

Alright

2019-02-18 20:42:21 UTC

so the irs and the rest of the us government overlooked this for over 10yrs?

2019-02-18 20:43:08 UTC

@ionic famine I don’t understand it. Looking at his history and his wrap sheet, he was known to police. The local authorities had to have known he was illegal. 🤔

2019-02-18 20:43:40 UTC

So, it hasn't been proven yet whether or not he staged the attack, although some stuff *is* suspicious. The police investigation is also pointing towards the attack having potentially been faked.
Now, assuming that he *did* stage the attack, the only illegal thing he did was knowingly file a false claim. Now, since it was not done with malicious intent (i.e. framing someone), the maximum punishment he should face, would be, in my eyes, a fine.

2019-02-18 20:44:18 UTC

Criminal charges are a no, because people don't face criminal charges for false reports. It's considered a misdemeanor, at most.

2019-02-18 20:45:48 UTC

can be a felony depending on juristicion

2019-02-18 20:45:52 UTC

...is that not exactly what I said?

2019-02-18 20:46:12 UTC

Except, since it wasn't done with malicious intent, it isn't a felony

2019-02-18 20:46:30 UTC

Nor was it done to obstruct an investigation

2019-02-18 20:46:54 UTC

Anyways, those are my thoughts on it

2019-02-18 20:47:10 UTC

It’s malicious intent to misrepresent the local culture of that region and cause division.

2019-02-18 20:47:19 UTC

agree

2019-02-18 20:47:51 UTC

I understand that, but the legal definition of malicious intent doesn't match that

2019-02-18 20:48:13 UTC

Now, if he had submitted the crime report online, then it's a felony

2019-02-18 20:48:19 UTC

Chicago has weird laws

2019-02-18 20:48:34 UTC

well he is taking away time from real investigations maybe not intentionally but he is

2019-02-18 20:49:11 UTC

Also. Now Smollett is accusing the Nigerian brothers of lieing. It’s been taken to the next level.

2019-02-18 20:49:38 UTC

We also need to take into account that he may be insane

2019-02-18 20:50:22 UTC

But, legally speaking, the longer this investigation drags on, the worse it'll be for him if he's found to be lying.

2019-02-18 20:50:51 UTC

Of course, politics often obstructs justice, so realistically, he won't face felony charges.

2019-02-18 20:51:02 UTC

I want to know how you know it wasn’t done with malicious intent.

2019-02-18 20:51:28 UTC

Alright.

2019-02-18 20:51:45 UTC

It's pretty much common sense.

2019-02-18 20:52:01 UTC

Without realizing it, you are coming to assumptions.

2019-02-18 20:52:03 UTC

If he staged the attack, he hired people to "attack" him

2019-02-18 20:52:06 UTC

Right?

2019-02-18 20:53:19 UTC

Yes. What’s your point?

2019-02-18 20:53:46 UTC

Now, if he was trying to frame someone, he'd have named a specific person

2019-02-18 20:54:02 UTC

And wouldn't have hired people with a connection to him.

2019-02-18 20:54:25 UTC

What is the goal of a fake hate crime gohan?

2019-02-18 20:54:28 UTC

In Chicago, malicious intent in reporting crimes is a "targeted attempt to undermine the legal status of an individual"

2019-02-18 20:54:40 UTC

Legally, it wasn't done with malicious intent.
