Can you post the link to that article?
I can finally respond to your question of the day, Gwench
@gohan Hey 😃
It's a very nuanced question, honestly
Hmmm
Alright
so the irs and the rest of the us government overlooked this for over 10yrs?
@ionic famine I don’t understand it. Looking at his history and his wrap sheet, he was known to police. The local authorities had to have known he was illegal. 🤔
So, it hasn't been proven yet whether or not he staged the attack, although some stuff *is* suspicious. The police investigation is also pointing towards the attack having potentially been faked.
Now, assuming that he *did* stage the attack, the only illegal thing he did was knowingly file a false claim. Now, since it was not done with malicious intent (i.e. framing someone), the maximum punishment he should face, would be, in my eyes, a fine.
Criminal charges are a no, because people don't face criminal charges for false reports. It's considered a misdemeanor, at most.
can be a felony depending on juristicion
...is that not exactly what I said?
Except, since it wasn't done with malicious intent, it isn't a felony
Nor was it done to obstruct an investigation
Anyways, those are my thoughts on it
It’s malicious intent to misrepresent the local culture of that region and cause division.
agree
I understand that, but the legal definition of malicious intent doesn't match that
Now, if he had submitted the crime report online, then it's a felony
Chicago has weird laws
well he is taking away time from real investigations maybe not intentionally but he is
Also. Now Smollett is accusing the Nigerian brothers of lieing. It’s been taken to the next level.
We also need to take into account that he may be insane
But, legally speaking, the longer this investigation drags on, the worse it'll be for him if he's found to be lying.
Of course, politics often obstructs justice, so realistically, he won't face felony charges.
