Most traps I have come across in anime & manga Identify as their biological sex, they rarely try to deny that they are cross dressing

interpretation of law

just decide to interpret the amendment in a really dishonest but technically not false way, and you can push the limits on it farther and farther down

So it is like the reverse of what has been happening with the first amendment for centuries.
