Peasants could have a wakizashi because it's short. There was a regulation length

If a commoner did not show respect to a samurai by kneeling etc, the samurai was legally allowed to behead him for it

But, the commoner was also allowed to defend himself as long as he didn't strike first

But also a halfway decent sword was not cheap
