@Kaladin I hate to say this, but most servers completely ignore Free Speech because it's not required by law on the internet

There is no such thing as free speech on the Discord, you can be banned for any reason and will not step in. I was banned from a community for being gay

I think when it comes to certain issues like homophobia or racism if the intent is very clear that it makes sense for more than a warning to be applied on the first go.

But when it comes to things that could be considered but we're not implied that way then I think a warning would suffice
