Probably, but if 343 went to sue they wouldn't really be able to garner any damages since the game was pulled nearly immediately before it even made it to an open beta state.
there are people trying to put the blame solely at the HK company's feet, which is bs, its pdx's own IP, and they aren't just publishing some random, just ugh
Like I said, I do agree that pdx has responsibility, but high name recognized publishers shouldn't be hiring mobile game studios with cruddy track records to create their games in the first place.
