Not really. The laws simply guide Discord what they must do. If Discord does not follow the guidelines, then they risk liability. The simple fact is that the TOS are the rules. The three rules listed are that:
(1) you must be 13 & the minimum age of digital consent in your country
(2) age of majority, and therefore bound,
and
(3) are 13, but not the minimum age of digital consent, but have parental permission.

I mean, I get the argument, but generally speaking the laws are made to protect certain classes. For example, the COPPA laws are created to protect children from obscenity, just as section 230 was initially introduced to protect the internet companies from liability for things others post that could be harmful to children.

Laws make society run efficiently and tend to set a code of how people are allowed to behave.
