Just a thought... you have to go through with a crime to be prosecuted for it unless it’s like attempted murder. What if we are just waiting for them to finish the crime. Like the SC couldn’t grant the injunction to keep the states from certifying the election results because “the crime” hadn’t yet happened. It would have prevented the crime from happening.
