The federal government can't, but the constitution can.

2020-12-24 05:32:25 UTC

Show me where

2020-12-24 05:32:33 UTC

Title 3 sec 1-12

2020-12-24 05:32:39 UTC

1-21*

2020-12-24 05:33:23 UTC

Guess this'd be easier.

2020-12-24 05:35:14 UTC

Title 3 sec 2 specifically talks about a state's elector's failure to make a proper choice. Their legislature is required to take over.

2020-12-24 05:40:18 UTC

That's not how that works. I just read through all those sections. They don't describe in any function, unless I missed it, that the President of the Senate can force a special session. And the issue, which everyone seems to be forgetting when I say this 18 times...is that all those sections only cover if the vote certification never happened. Not if it was wrong. That's why Kemp is such a cockbag

2020-12-24 05:40:39 UTC

Sec 2 is what you're looking for, man.

2020-12-24 05:40:50 UTC

I'm literally reading it

2020-12-24 05:40:56 UTC

If they fail, their legislature must fix it. The president of the senate would invoke that title.

2020-12-24 05:41:09 UTC

He cannot invoke that.

2020-12-24 05:41:16 UTC

Yes, he can.

2020-12-24 05:41:16 UTC

That is for if they fail to choose at all

2020-12-24 05:41:26 UTC

Yes, like a de-certification.

2020-12-24 05:41:35 UTC

Or those dueling electors that all seven battleground states sent.

2020-12-24 05:41:54 UTC

Seems an awful lot like an inability to choose to me.

2020-12-24 05:41:57 UTC

Right, and the state Executive branch or legislature has to call for the decertification themselves

2020-12-24 05:42:06 UTC

As they have.

2020-12-24 05:42:36 UTC

They can call for it all they want, they're sounding the alarm to put it in motion.

2020-12-24 05:42:41 UTC

But they haven't fully done it yet. But Pence does not have that power to do it. He can demand it sure, but they can tell him to fuck off

2020-12-24 05:42:47 UTC

But the deadline to send electors must pass before the next step can continue.

2020-12-24 05:43:25 UTC

Which statute wise it did

2020-12-24 05:43:37 UTC

Yes, tomorrow is when it goes to Congress.

2020-12-24 05:43:43 UTC

And whatever happens, happens.

2020-12-24 05:43:48 UTC

It already went to Congress

2020-12-24 05:44:10 UTC

Remember that day when the GOP of contested states sent their own Electors?

2020-12-24 05:44:16 UTC

All that shit is sealed

2020-12-24 05:44:17 UTC

You don't understand - The VP is going to supervise the electoral votes.

2020-12-24 05:44:24 UTC

Yes...on the 6th

2020-12-24 05:44:25 UTC

I've been sitting here all day worried about weather or not pence would betray us over the Pencecard thing, and it was all for nothing cause we dont even gotta worry about it til' the 6th

2020-12-24 05:44:40 UTC

Read section 15

2020-12-24 05:44:59 UTC

That describes what's actually applicable to the situation we find ourselves in

2020-12-24 05:45:33 UTC

Members of Congress say that the Electors were sent with fradulent certification

2020-12-24 05:45:48 UTC

THEN. Pence, as President of the Senate comes into play

2020-12-24 05:47:16 UTC

Yeah I see that now.

2020-12-24 05:48:08 UTC

That's what everyone is getting wrapped around the axle about. It's about arguing that the certifications are bullshit, not that they don't exist

2020-12-24 05:48:20 UTC

As they are.

2020-12-24 05:48:24 UTC

Right

2020-12-24 05:48:52 UTC

So, the ball is in Pence's court now. It's up to him at this point.

2020-12-24 05:49:06 UTC

If Trump doesn't seem rattled by it, nobody else should.
