The federal government can't, but the constitution can.
Show me where
Title 3 sec 1-12
1-21*
Guess this'd be easier.
Title 3 sec 2 specifically talks about a state's elector's failure to make a proper choice. Their legislature is required to take over.
That's not how that works. I just read through all those sections. They don't describe in any function, unless I missed it, that the President of the Senate can force a special session. And the issue, which everyone seems to be forgetting when I say this 18 times...is that all those sections only cover if the vote certification never happened. Not if it was wrong. That's why Kemp is such a cockbag
Sec 2 is what you're looking for, man.
I'm literally reading it
If they fail, their legislature must fix it. The president of the senate would invoke that title.
He cannot invoke that.
Yes, he can.
That is for if they fail to choose at all
Yes, like a de-certification.
Or those dueling electors that all seven battleground states sent.
Seems an awful lot like an inability to choose to me.
Right, and the state Executive branch or legislature has to call for the decertification themselves
As they have.
They can call for it all they want, they're sounding the alarm to put it in motion.
But they haven't fully done it yet. But Pence does not have that power to do it. He can demand it sure, but they can tell him to fuck off
But the deadline to send electors must pass before the next step can continue.
Which statute wise it did
Yes, tomorrow is when it goes to Congress.
And whatever happens, happens.
It already went to Congress
Remember that day when the GOP of contested states sent their own Electors?
All that shit is sealed
You don't understand - The VP is going to supervise the electoral votes.
Yes...on the 6th
I've been sitting here all day worried about weather or not pence would betray us over the Pencecard thing, and it was all for nothing cause we dont even gotta worry about it til' the 6th
Read section 15
That describes what's actually applicable to the situation we find ourselves in
Members of Congress say that the Electors were sent with fradulent certification
THEN. Pence, as President of the Senate comes into play
Yeah I see that now.
That's what everyone is getting wrapped around the axle about. It's about arguing that the certifications are bullshit, not that they don't exist
As they are.
Right
So, the ball is in Pence's court now. It's up to him at this point.
If Trump doesn't seem rattled by it, nobody else should.
