Grand jury finds officers justified in shooting Patrick Kimmons; protesters block streets
PORTLAND, Ore. – After a two-day hearing, a grand jury determined the Portland Police officers who shot and killed a man on Sept. 30 will not face criminal prosecution.
Multnomah County District Attorney Rod Underhill announced the decision Wednesday.
The grand jury returned a not true bill regarding the officers’ use of force. This means they determined that the officers’ use of deadly force against 27-year-old Patrick Kimmons was a lawful act of self-defense or defense of a third person.
The county’s investigation began immediately after the officer-involved shooting occurred.
Protesters blocked the intersection of Southwest 4th Avenue and Southwest Main Street after hearing the news of the jury’s decision.
The Portland Police Bureau says Officer Jeffrey Livingston and Sergeant Garry Britt were on patrol near the intersection of SW 4th Avenue and Harvey Milk Street around 3 a.m. when they encountered a fight between two people.
Police say during the fight, Kimmons fired five shots, injuring both the people involved in the fight. The injured people were later transported privately to local hospital and survived their injuries.
Officers say Kimmons began running toward officers and other people in the area with his revolver.
Officers fired 12 rounds at Kimmons.
Police released surveillance video of the shooting:
An Oregon State Medical Examiner determined Kimmons was shot nine times and died from his injuries.
Family told KATU that Kimmons was shot in the back several times while running away from police.
The Portland Police Bureau says it is conducting an internal administrative investigation of the entire incident. Once the investigation is complete, the case will be presented to the Police Review Board.
