Today we learned that the Pennsylvania State Police have been instructed not to enforce federal Immigration and Customs Enforcement warrants.
The reason given was that if they detain the individuals there is a time constraint within which they must release the individuals under the law if they cannot be transferred to ICE.
I dealt with ICE detainer warrants for eight years with the Department of Corrections and can tell you ICE contracts with the York County Detention Facility to take custody of these individuals for the federal government. Once the individuals are transferred to federal custody at this facility the responsibility for timeliness falls on the federal government.
Governor Wolf’s administration is forcing our troopers to make Pennsylvania a de-facto sanctuary state!
I’ve passed the information to Appropriations members in hopes we confront this fallacy before the hearing ends.
NOTE: This is not a reflection on our State Police Troopers who are out there trying to enforce the law. This is a policy decision.
