Continuing resolution and Omnibus Bills give the President all the power going into a shut down, as he can choose to defer the assets any way he wishes since their is no "budgetary" allocation requirement affixed by Congress. Additionally, He can keep them shut down until they "do" decide to produce a real budget, which is one of the intentions, I believe of this shut down. Just thinking out loud.
