Well it's simple, I see crime as a societal failure, not just the failure of the individual. It is the job of the nation and therefor the people to make sure that the youth are raised up to be strong pillars of the community. For example if a man is prone to beating his spouse it's probably because he too was raised around such violence. It takes a village to raise a child, which is why neo liberalism prefers to destroy the sense of community, for they dont want men of character, they want slaves. Punitive justice in the modern world is just an excuse to not adress the problems liberalism caused.
Criminals have always and will always exist. The problem may be exacerbated or decreased by the societal structure, but fundamentally you will always have people who will break the law.
But I broadly agree, neo-liberalism is cancer and destroys communities.
But I also think that the main goal of the law should be to maintain order, not to try to rehabilitate criminals back into the society.
Well they don't do well at maintaining order, send a crook to prison and he'll just learn to be a better crook. I agree some people just need the punitive treatment, but a lot of these people are the result of the system and will only perpetuate the cycle of violence if not given propper treatment.
Ontop of that this approach allows you to also reducate political dissidents by sculpting them into propper citizens, instead of letting them be a thorn in the side of your nation.
Just put them under forced community service to pay for the paychecks of the Sinecures
I believe some criminals are predisposed to criminality by birth, and no amount of rehabilitation will change that. Those people should get the bullet. The others, who commit crimes because of unfortunate circumstances should be attempted to be rehabilitated, but should still be punished for what they did.
