long story short: i'd rather get arrested and give them nothing than probably still get arrested anyway and potentially give them something with which to convict me
You are now being intentionally obtuse. I never meant "don't say hi to police"
the context is
the police suspect you or want to question you
you do not answer questions without counsel present
point blank period
oh ffs
yea you can walk down the street and say "good afternoon, officer"
therefore you can say that my point is mute saying "don't ever talk to the police"
moot*
After a gunfight and the adrenaline dump that comes with it, I wouldn't trust myself to remember a perfectly rehearsed statement and stick to it
yea
yea
i'd rather look guilty and not give them anything which with to prove it, than try to come off as innocent only to unintentionally give them the noose with which to hang me in court
While I respect Mr. Ayoob, he has never had to defend anyone in court. I, respectfully, will take a defense attorney's advice over his in this instance
right
the simple rule is one of those rules of thumb. Is there a 0.1% instance that giving a limited statement to the police might somewhat help?
Maybe
but there's a 99.9% chance that giving statements will hurt you in the long run
like i said, you're being intentionally obtuse and contrarian here. It's not a literal statistic.
yea i can't attempt to give a counterpoint when i'm not sure what you're saying
I think the point that Maw and I are making / have made is that we wouldn't risk the chance that our statements may direct the police to process elements of the scene vs the probability that our statements may be later used against us.
Speaking of don't talk
apparently Rittenhouse talked to The Washington Post and pretty much admitted that he had his friend perform a straw purchase to buy him a rifle
...how and why did his lawyers let him be interviewed by The Washington Post and admit to a straw purchase taking place?
Totally unrelated, but, I was going to get on a plane and go see family in California for Thanksgiving. However, given the uncontrolled uptick in new COVID-19 cases, coupled with the CDC's very strong recommendation to avoid Thanksgiving travel, I cancelled my JetBlue flight. Feels bad, man.
Yea, above all else I think that Rittenhouse and his poor mother were taken in by these vultures swooping in from overhead who wanted to A) make this cause a cause cรฉlรจbre for 2A rights and B) solicit donations to "help Kyle" but really just using the money to pay for other expenses in this "foundation."
More than any of that, though, I just think that they've done him a disservice by not using their best judgment in terms of doing what is actually best for him given the situation.
Glad they got them out of there. there was this Twitter account that was soliciting information on Kyle's cell number when he got to jail
that was a pretty scary tweet, lol
glad he's out of there.
I've had the "White privilege" discussion with a number of my progressive friends and I can never get them to articulate a logical reason for what it is beyond this idea that I benefit from it because I am white.
My stock answer is: Oh, I AM privileged. I am privileged to have been born to my mother and father who worked damn hard in order to provide me with what I have now.
None of that has to do with skin color...but with grit and determination
but, I digress
Kyle's next court date is in like...a week and a half, right?
Do we know what is happening then?
yea
What happens in a preliminary hearing like that?
yea
the judge is determining if there is evidence of the crimes
not evidence of defense
i guess
the reckless endangerment or w/e of McGinnis may be the only one open to debate
over whether he was directly in the line of fire
but idk
going back to the ballistics discussion
it is quite common, when someone is shot, that they turn and twist as they fall down
so the whole bullet in the back thing is probably a result of that
wasn't one of the shots in the hip or thigh?
thing is, I only counted 4 shots being fired by Rittenhouse. the ME listed 5 wounds, right?
yea, this way his cell number won't get leaked to that sketchy twitter account who wants to put a hit out on him
Yea, Mati. The court system in The Bronx, specifically, is so dysfunctional that it beggars belief.
not sure how that works, tbh
yea, some states let you put up 10% I think
"Binger alleges that Pierce has also used Twitter to attack the character of Kenosha County District Attorney Michael Graveley.
โHe has called for DA Graveley to be recalled by voters and accused him of being tied to George Soros, a billionaire philanthropist who is regularly accused by conservatives of financing various nefarious global plots,โ the motion states."
only....
even Politico acknowledges that Soros has been splashing the cash lately to elect local DAs in his image
this isn't some conservative conspiracy
unless Politico is a secret cover for Breitbart or The Daily Caller
it should be relatively easy to figure out whether or not Soros put up the bucks for Graveley
this being said
i haven't seen any evidence yet that Soros put up money for THIS DA's election.
However, his prosecutorial history does fit the bill for the type of attorney that Soros would bankroll
yea i feel bad for the kid. just getting jerked around by wood and pierce
milking him for all he's worth
I think he just stepped out of managing the #FightBack foundation or w/e it's called. He's still on the case
And just filled for a . . . I forget what the official Latin name is
translates to "on this occasion"
filed a petition for the Wisconsin court to allow him to practice in Wisconsin for the sake of this case even though he is not licensed to practice in that state.
haha, yes
Kyle would be better off with just his Wisconsin lawyer representing him and not this Lin Wood / John Pierce sideshow. But, hey, what do I know? I'm not a lawyer. ๐
Thank you, aiva.
yea
Pierce and Wood bring absolutely nothing to Kyle's criminal defense
like
literally nothing
a net negative, as Gary Cohen would say
This is sort of going back in time, but with regard to the hearing on the 3rd of December. Wasn't this already done? A judge in Illinois made the determination that the charges were valid enough for extradition. A court commissioner earlier this month made the determination that the charges are warranted enough to set bail at $2 million.
I am not a trial lawyer, nor a lawyer at all, I just studied health care law as part of my MPH - this seems like another redundancy to me.
i missed it
what happened in the hearing?
or has it happened yet?
ah ok
I find it very distracting to have Grosskreutz and his lawyer present at every hearing. I just find it wholly unnecessary to have him there in the first place
that is as a result of the boilerplate Marsy's Law which declares a victim before the accused has had a chance to clear themeslves
I'm aware
but you see the conflict of interest?
It declares a victim in contravention to the presumption of innocence
agreed
100%
I'm also not a fan of this Court Commissioner, but that's neither here nor there
I'm watching the bit now where Attorney Richards argues that Count 6 should not apply because a complete reading of 948.60 (specifically 948.60(3)(c) ) indicates that it doesn't apply to Kyle
Commissioner Keating's response is basically "Well, a plain language read indicates that Kyle Rittenhouse was not 18 and possessed a dangerous weapon."
....but that's not reading the whole statute!
so frustrating
