I think this man takes this differently than he ought to, yeah. The courts have not, and do not, see collection of your data from third parties you have entrusted it to be a "search".
Nor do they consider looking at those data to be a "search", and that is the contention.
It should still be considered your property even if it's held by a 3rd party
I think so too, so maybe this is one of those things Congress should be getting off of their asses to do.
Then again, it is difficult to draw the line, because law enforcement can observe you in public. When does looking at things you have disclosed to third parties stop being an observation of a public space, and start being an infringement upon private space?
