Here is an article that gives details from Sex Bias in the U.S. Code: A Report of the U.S. Commission on Civil Rights https://nworeport.me/2018/01/30/supreme-court-justice-ginsburg-favors-decriminalizing-pedophilia-and-child-sex-trafficking/ Ginsberg co-authored this in 1977. She advocated for the age to be lowered to 12 years of age AND if you look closely at the language used, it appears to me that as long as the the person over 12 is willing, it would not be a crime. This would put the responsibility on the child to make a decision, not hold the offender responsible. The section is below.
THIS: S. 1400 §1633: A person is guilty of an offense if he engages in a sexual act with another person, not his spouse, and (1) compels the other person to participate: (A) by force or (B) by threatening or placing the other person in fear that any person will imminently be subjected to death, serious bodily injury, or kidnapping; (2) has substantially impaired the other person’s power to appraise or control the conduct by administering or employing a drug or intoxicant without the knowledge or against the will of such other person, or by other means; or (3) the other person is, in fact, less than 12 years old.
There may be more to this based on another article I just read, saying that she was using a proposed Senate bill as an example to create gender neutral language.... not actually advocating for lowering the age.... Researching for more details, but would love some other input on this.
I remember that also, she was changing the language to make things gender neutral and sort of snuck in the age change nonchalantly hoping no one would notice.
