I think it will be hard to prove that he actually intended to exhonerate her ahead of time. He could just say, "i drafted that speech ahead of time, just in case" and it will be impossible to prove otherwise, unless the exhoneration write up says something specific about "this is my plan."
Criminal law requires you to prove things beyond a reasonable doubt, and that's pretty hard
still, in most people's minds, this will be an obvious tell that he the fix was in ahead of time.
