@Goose They could not. Discrimination laws don't care about how neutral a requirement is, only about its result. If you say, to do this job, you must have at least a 120 IQ, and end up with a bunch of whites and Asians, you're discriminating against blacks. Doesn't matter if you hire some 120 IQ blacks too, it's an unequal outcome, therefore discrimination.
At least that's how I've always seen those things go down.

You can get away with unequal outcomes in hiring if your hiring methods are well documented and the criteria is objective and directly related to the job. IQ tests have been deemed too non specific but, for example, coding tests (which are basically iq tests) are ok if the job I solved coding.
To be safe most companies fall back on college credentialism which is always safe.
If you're involved in hiring, design and implement objective testing. Don't empower the education gayplex if you can avoid it.
Not only is it better for whites, objective testing outperforms credentialism when it comes to selecting the most successful employees.
I heard you're allowed to discriminate in hiring if your small business is under a certain number of employees. I forget the number though.
