AUSTIN (KXAN) -- Issues stemming from Austin's land development code changes has the state of Texas taking legal action. In a suit filed July 2, the state's attorney general says eight members of Austin's Planning Commission can no longer serve and are "unlawfully" holding office.
KXAN Investigator Kylie McGivern explained in early May why one group says the current makeup of the council-appointed commission is illegal.
There have been complaints that too many people on the commission have ties to real estate and land development. The city charter states that out of 13 members on the commission, there shouldn't be more than four people with those types of connections.
When KXAN reported the story in May, we determined there were seven people with real estate connections, however, the suit claims there are eight members with those ties. Those members are: Karen McGraw, Trinity White, Fayez Kazi, James Shieh, James M. Schissler, Patricia Seeger, Greg Anderson and Tom Nuckols.
A group of seven individuals submitted the complaint to the Attorney General's Office several months ago.
"We had complained to the DA[ district attorney], CA [county attorney], and AG [attorney genera] because they have authority to bring a “quo warranto” action to remove people from office who don’t qualify for the office," wrote complainant Bill Aleshire in a statement to KXAN. "Fred and I met with Mayor Adler about this in 2016 and he said he would get it fixed, but he did not. So we formalized the complaint.
Aleshire says his group is really focused on keeping "special interests from dominating the Planning Commission at a time it is considering CodeNEXT"
