It has come to our attention that certain journalists are making false, unsubstantiated claims against our server. They have claimed that our server is promoting hateful ideologies, that our server doesn’t even exist anymore, and that the administration team of this server encourages “Nazi ideology”. These claims are obviously and verifiably false. Who these journalists are do not matter, since we are a good, wholesome server that does not attack or bombard others. (Also, it is worth mentioning that the only sources these journalists used was a Reddit post.)

I have wiped the main chat channels as a precaution, as these journalists have showed they have no integrity in their reporting. My fear is that they will take comments made by our users completely out of context, and use them to pressure Discord into suspending that user’s account, or possibly our server. This would not be the first time this happen. Around the time of the CC coup, a journalist took a screenshot of a new user (with the New User role) saying that “There were no bodies on the scene” referring to the Las Vegas shooting. He then proceeded to claim that we had a chat room that was dedicated to proving the LV shooting was a false flag, simply because one new user said so.

For as long as these journalists are actively attacking our server and looking for ways to get us shut down, we will be instituting a more extreme form of moderation, just as a precaution.

**TL;DR, we have wiped the main chat channels as a precaution, because journalists with no integrity are taking user’s comments out of context.**

Luckily, there is an opt-out for the clause, in which **you must email [email protected]**, but **you must do it within 30 days** or you can no longer opt-out.

I will attempt to answer some common questions.

**Is this enforceable?**

In the United States, **yes**. This was decided by the Supreme Court in 2011. See <https://gc.gy/7538114>

In Europe, **no**. There are many clauses, a relevant one is Article 77 of the GDPR ("Right to lodge a complaint with a supervisory authority").

**Why does this matter?**

Without the ability to congregate for a class action lawsuit, if Discord ever leaks your data or does something catastrophically bad to a large portion of the population you have no way to representatively sue together without each of you individually suing via the arbitrator.

Essentially:

1. Your right to file a complaint in the court of law is removed.
2. The arbitration system tends to heavily favour the company rather than the consumer.
3. Since your right to pool similar complaints together is taken away, the amount of damage you can do to a company that has wronged you significantly is limited to those who are willing to arbitrate.


**What you need to do to opt-out**
Email `[email protected]` from the email associated with your account, with the following (no special formatting required):
Subject: Opt-out from the arbitration clause
Content: I'd like to opt-out from your arbitration clause. user#0000

This will take you one minute and will preserve your right to sue or participate in a class action against Discord
