This is not a game. John Rivello, a.k.a. "Jew Goldstein" is going to do time.
It is not relevant that Kurt Eichenwald probably did not have a seizure. I don't believe at all that he did. The statute does not criminalize communications that cause seizures. It criminalizes communications sent with an intent to cause harm. A seizure is definitely physical harm, and Rivello acknowledged that he knew Eichenwald was epileptic.
The statute is constitutional.
No lower court, appeals judge, or sitting SCOTUS judge is going to say that it is okay to make epileptic people have seizures.
Rivello is going to do time. There's no avoiding that.
These are federal fucking charges. The charges are valid. This is not a game.
If you see somebody attempting to get an entire group of people to commit federal crimes, then the fucking Racketeer Influenced and Corrupt Organizations Act kicks in. Which means they will try to charge anyone that engaged in the activity or plotted to engage in it as a gang, with insane sentencing enhancements.
