i think the most damning piece is that 1/3 of the times the guy got paid for that image, was after the "infringement", which was used more for the fact it portrayed (aka showing a location with little to no alteration), than any creative part of it. So its hard to him to claim he was hurt financially. Also that it was taken down near immediately as soon as he made it clear it was his work.
